Mandamus
Hi guys, I need your help on these, My wife petitioned an i730 in 2014 and was approved on 2015 had a consular interview on December 2018 due to travel ban it has been stuck in administrative process till now. Then we filed i130 on July 2019 and was approved on July 2022 when we hired a lawyer using a mandamus, I had my interview on December 5th 2023. I want to file a lawsuit again, is it to early on the i130 or which case do we focus on, the two cases are on administrative process, I need your experience guys, thanks My wife and our children are US citizens.

I’m not in the US but abroad, I’m doing consular process I had a previous case of i730 and when my wife became a citizen she filed an i130 on July 2019 which took long to be approved so she hired a lawyer who filed a mandamus and was approved on July 2022 and I did the consular interview on December 5, 2023 and was put to administrative process so my question is; Can I file mandamus with the I130 case or is it too early? i hope you understand now and thanks

@Eliza Day hi I have 1 questions for you I apply my AOS 26 Aug 2022 and I spouse is USC and we both live in said the US , almost 19 months passed for both form I-130 and I-484 and July I have my 2nd marriage anniversary coming so can I file mandamus now or should I have till July 2024 pls advise me my EAD approval in July 2023 and I m working good and I have all evidence now ,

@Eliza Day yea I agreed with you but same people saying 19 months. for I-485 my filling date is 26 Aug 2022 can you send me link where you checked . it sow me uscis website 14.5 months 80% case approved

@Eliza Day person doesn't have to exhausted all other options! @Singh USA 🇺🇸 if you have strong case, and suffer from the delay. You can sue USCIS for a delayed case on your own, you will get a decision within 60 days. Do youtube search to learn more about it, and to get assistance with it "Writ of Mandamus Pro Se"

@January 11 I have seen people sued for 2 cases within one mandamus. And they were approved for one, or both.

@Eliz thank for the advice @Mark thank you, that was what i was thinking to do even though i had the consular interview about 5 months ago but the previous one i750, we waited for way too long, We hope to consolidate with one litigation.

@Eliza Day 1 more questions please if i upload my evidence in my uscis account I need to give them each month car insurance and each month life insurance and each month utility bills or just one copy starting month only ?????

@Eliza Day yes I m just keeping all in one file and waiting for pass 2 years and then I try to upload all new documents which is they don’t have if not work then I do lawsuit?
