i751 - travelling
hi Community, I’m applying for removal of conditions. I had the 18 months extension letter 14 months ago. I received a RFE to show marriage is bonnafide on January and I responded on March. they have received it but no response yet. would you recommend travelling overseas during this period while waiting for them to respond. I want to spend 14 days starting from end of April. Also can they deny you straight after RFE or they have to send you another letter ? thanks

I also received a RFE from I-751 form. I got it in February and responded by March 15. last week my case was approved and card was mailed. If you sent out everything they asked for, they either will approve you or will schedule an interview. I don’t think they will deny a case without an interview. Regarding your extension letter, I would recommend to wait until a decision is made. (just my opinion) it could be different but I wish you the best of luck!

congratulations on your approval 🎊🎉 thank you, it helps a lot. I also think it’s safer to wait for a decision first. Which service center did you send your response to RFE ?
Rocco FortéApr 19, 2021
@Prince what did you send in your original packet

pictures, insurances with our name on it ( dental, life, car) car registration, lease, affidavit and Ids stuff like that I didn’t have a bank account
Rocco FortéApr 19, 2021
what about taxes? did you file taxes together? did you take trips?
C

oh yea I forgot, I had last 3 years tax returns ( married filed separately) and No
Rocco FortéApr 19, 2021
I think that’s the issue. no bank account and filing separately will tickle a USCIS officer

yes, I think so too. we had a bank account but it was closed a couples months after we opened it. while I was applying for the 2 year green card, I have submitted copies of debit card and statement. by the time we applied for the renewal the account was closed. I should have submitted that too even if it was closed
Rocco FortéApr 19, 2021
yea or you should have written a letter explaining why you don’t have bank account

you’re right. now the interview is inevitable I guess
Rocco FortéApr 19, 2021
depending on what you sent them with your RFE response they might just approve it

I’m praying for that. thank you
Rocco FortéApr 19, 2021
what further evidence did you send with your response?

I'm in the sake boat. with similar timelines...but my i751 got transferred from Nebraska to Lees Summit...and God knows what that means

@rocco, they asked to provide them the G 325 biographic information for my wife and I. the file where you list your adresses for the past 5 years and any other evidences that I can find

@bil, my processing center is in Nebraska too. I heard they were one of the fastest. I don’t know much but I think that’s an interview coming

Bil DeenApr 19, 2021
oh great ... let's hope for the best and a favorable result soon. it's so tiring to keep waiting. thanks ALL
Rocco FortéApr 19, 2021
Form G 325? that’s very strange. was any of you married before?
Rocco FortéApr 19, 2021
@bil you case was transferred to be scheduled for an interview. in rare cases they approve without an interview after transferring to NBC

@rocco, yes I was from 2013 to 2016. do you think that might something to do with it ?
Rocco FortéApr 19, 2021
Yes. they are checking the time between when that marriage ended and when you got married to a USC who immediately filed for your Greencard. Also if that divorce was in a foreign country they are checking its legitimacy. where are you from if you don’t mind me asking?
C

oh I see. that was here in the US and Ivory Coast
Rocco FortéApr 19, 2021
ok they will send people to the addresses you lived at before both here and Ivory Coast to investigate
Rocco FortéApr 19, 2021
i’m guessing you got married to your new spouse almost immediately your first marriage ended

@Rocco you seem to know a lot about this subject. On March 31st my status updated to transferred another jurisdiction. On April 1st I got ANOTHER update saying I was again transferred to another jurisdiction. Then 1 week later I got a letter in the mail saying my case is in Lee's Summit. but on the phone when I asked a representative why I was transferred twice, she said I'm back in Nebraska. Does anyone know why something like this could happen? back to back days ☹️☹️☹️
Rocco FortéApr 19, 2021
Alright. As long as your marriage is Legit and your first marriage ended in a divorce that you have the decree you will be fine, you just have to wait
Rocco FortéApr 19, 2021
@bil don’t listen to those people on the phone they will mislead you. you case was transferred to NBC to schedule for interview but sometimes they will take a second look based on the evidence you provided and decide to just go ahead and approve
B
Bil DeenApr 19, 2021
@Rocco I hope that was the case and that's why they sent it back to Nebraska. Thank you for putting my mind at ease Rocco. you are doing GREAT work here honestly.
Rocco FortéApr 19, 2021
Glad I could help

in my opinion, when cases go back to Lee’s summit it’s usually for quality control and some verification. To be honest evidences and reviewed and decisions are made on a case by case basis. In my own case, I only had bank accounts off and on since I married in 2016 but I made sure I sent them all the statements for all the time we shared bank accounts. I want to believe that it’s your divorce that’s causing all the red flags but I would think they sorted it all out in you initial AOS application.
