Green card holder sponsor spouse
Hi everyone, I currently have a green card for 2 years now and I’ll be eligible for citizenship in about 3 years(a total of 5 years). I just got married and my spouse overstayed her holiday visa and now I have to file for her(she is currently in the US too). I do see that for the category F2A the priority date is “current” meaning I can file both the i130 and i485 but the issue is I am seeing everywhere that I’ll need a waiver(i601A) because she violated the terms of her visa and because am not a citizen. So right now what will happen if I file for the i485? Will it be automatically be rejected without the waiver or will she be given a work permit until she is called for the interview then get rejected because she doesn’t have the waiver? I am asking because if she can get a work permit for now that will be good while she waits then maybe by the time they call us for the interview I would have been a citizen by then and the waiver will not be necessary.
